These Terms of Service govern access to and use of BuildingTrax by organizations, administrators, and invited users.
Agreement to terms
By accessing or using BuildingTrax, you agree to these Terms of Service and our Privacy Policy.
If you use BuildingTrax on behalf of an organization, you represent that you have authority to bind that organization to these terms.
Accounts and responsibilities
You are responsible for account credentials, access controls, and all activity under your account.
You must provide accurate information and keep it current.
You agree to notify us promptly if you suspect unauthorized account access.
Permitted use
You may use BuildingTrax only for lawful business and community-management purposes in compliance with applicable laws.
You may not attempt to disrupt the service, bypass security controls, reverse engineer protected functionality, or misuse another person’s data.
Customer content
You retain ownership of data and files you submit to BuildingTrax.
You grant us a limited license to host, process, transmit, and back up your content solely to provide and improve the service.
Intellectual property
BuildingTrax, including its software, interface, and documentation, is owned by us and protected by applicable intellectual property laws.
Except as expressly granted, these terms do not grant rights to our trademarks, branding, or proprietary technology.
Suspension and termination
We may suspend or terminate access if you materially violate these terms, pose a security risk, or use the service unlawfully.
You may stop using the service at any time.
Disclaimers and liability limits
BuildingTrax is provided on an as-is and as-available basis to the fullest extent permitted by law.
To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, special, consequential, or punitive damages.
Our aggregate liability for claims arising out of or related to the service will not exceed the amount paid by you, if any, in the 12 months before the event giving rise to liability.
Governing law and updates
These terms are governed by applicable law in the jurisdiction identified in your order form or, if none applies, our principal place of business.
We may update these terms from time to time; continued use after updates become effective constitutes acceptance of the revised terms.
